Waiver / Release

THIS RELEASE AND WAIVER OF LIABILITY (the “Release”) is made by the Resurrection Run Participant (“RRP”), or the parent or guardian of the named RRP, in favor of Ayden United Methodist Church (“AUMC”).

In consideration for RRP’s participation in AUMC’s 5K and 1-mile run, the RRP waives and releases AUMC as follows:

Waiver and Release. RRP does hereby release and forever discharge and hold harmless AUMC and its successors and assigns from all liability, claims and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from RRP’s participation in the 5K and 1 mile run. RRP understands and acknowledges that this Release discharges AUMC from any and all liability or claim that the RRP may have against AUMC with respect to any bodily injury, personal injury, illness, death or property damage that may result from RRP’s participation in AUMC’s 5K and 1-mile run, whether caused by the negligence of AUMC or its employees, members, agents or otherwise. RRP understands that AUMC does not assume any responsibility for or obligation to provide financial or other assistance to RRP, including but not limited to medical, health or disability insurance, in the event of injury or illness.

Assumption of the Risk. RRP understands that participating in this 5K and 1-mile run may be hazardous to RRP, and in connection thereto, RRP recognizes and understands that RRP’s participation in this event may, in some situations, involve inherently dangerous activities. RRP hereby expressly and specifically assumes the risk of injury or harm in these activities and releases AUMC from all liability for injury, illness, death or property damage resulting from the activities of RRP in participation in the 5K and 1-mile run.

Miscellaneous. RRP expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the State of North Carolina, and that this Release shall be governed by and interpreted in accordance with the laws of the State of North Carolina. RRP agrees that if any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable.

The course is illustrated below. Runners and walkers can park in the gravel parking lot beside the church or in the grass lot immediately behind the church and adjacent to the starting line.
